If a government or law enforcement agent subjects another person to the deprivation of any rights, privileges, or immunities secured by the Constitution, that government agent and their agency may be liable for damages to the person injured. 

This category includes violation of free speech rights, abuses of power, unlawful searches and seizures, and excessive force, whether or not an arrest itself may be lawful.
